At the same time, New Jersey has some of the most obscure and absurd laws in the nation. For example, in the state of New Jersey, it’s illegal to frown at a police officer. It’s also illegal to buy or sell ice cream after 6 p.m. in Newark unless you have a note from your doctor.

In comparison to insurance laws in other states, insurance laws in New Jersey are very complex. Even though it’s a necessity, searching for car insurance sometimes feels unnecessarily difficult. Spending so much time deciphering complicated insurance laws and calling various insurance companies to get a quote is a hassle by almost any definition.

New Jersey Car Insurance Coverage and Rates

In addition to being complicated, insurance in New Jersey is expensive. The national average premium is $1,009.38, more than $300 less than New Jersey’s average of $1,382.79.

This isn’t entirely unexpected, given that New Jersey has the highest population density of any place in the country, including Los Angeles and New York City.

What is New Jersey’s car culture?

In New Jersey, people think about cars and roads a little bit differently than they do in other states. When someone in New Jersey wants to tell you where they live, they give you a highway exit number instead of a street name.

Even neighboring New York City thinks about the citizens of New Jersey based on their roads, sometimes referring to people who commute into the city from New Jersey as “bridge and tunnel” people.

When it comes to putting gas in your car, New Jersey leaves that to the professionals. State law says that gas must be pumped by a station attendant, not the driver.

How much coverage is required for New Jersey minimum coverage?

Here is where car insurance in New Jersey starts to get tricky. New Jersey is a no-fault state, which means that in the event of an accident, each driver is responsible for their own costs. So drivers in New Jersey don’t technically need a whole lot of liability insurance — in theory, at least.

In New Jersey, the law requires every driver to choose one of two options:

Option A – Standard policy (Elected by Most Drivers)

  • $15,000 in bodily injury liability per person / $30,000 per accident
  • $5,000 in property damage liability
  • $15,000 in personal injury protection per person
  • $15,000 in uninsured/underinsured motorist coverage per person / $30,000 per accident

Option B – Basic policy

The basic policy offers a minimal amount of coverage:

  • $5,000 in property damage liability
  • $15,000 in personal injury protection per person

With the basic policy, you can also choose to add $10,000 in bodily injury liability along with a small amount of collision and comprehensive coverage, but it isn’t required. Uninsured/underinsured motorist coverage is not available, which is unfortunate when you consider that almost 15 percent of drivers in New Jersey are driving uninsured.

The basic policy also limits your right to sue another driver in the event of an accident. The standard policy can include expanded rights to sue another driver in court for damages.

This means that if you hit someone in an accident in New Jersey, there is always a chance that they have the right to take you to court, so the limited liability amounts offered in the basic policy probably won’t be enough to cover the damage you’ve caused.

What are forms of financial responsibility in New Jersey?

Your insurance company is required to provide you a paper or electronic copy of your New Jersey insurance identification card for each vehicle under your policy. New Jersey insurance identification cards must include the following:

  • The front of the card must contain the insurance company’s name, the insured’s name and address, the policy number, effective date, expiration date, make, model and VIN of the vehicle, the heading “State of New Jersey Insurance Identification Card,” the insurance company code, and the name and address of the insurance company issuing the ID card.
  • The back of the card must include the address established by the insurer for the filing of notification of medical treatment by medical providers.

In New Jersey, the insurance ID card may be displayed either on paper or in electronic form, such as a smartphone or a tablet.

You must keep the card in the vehicle, or be able to produce the electronic version:

  • Before an inspection
  • When involved in an accident
  • When stopped for a traffic violation
  • When you are stopped in a spot check by a police officer

Failure to present proof of financial responsibility may result in fines. Driving an uninsured vehicle may result in fines, community service, license suspension, and insurance surcharges.

How much percentage of income are premiums in New Jersey?

There are a whole host of factors that can affect your insurance premiums. Everything from your driving record to your age and gender can affect your rates, sometimes for the better and sometimes not. This can make figuring your premium as a percentage of your income difficult.

Young people with poor driving records could be spending 20-30 percent or more of their income on their insurance, while someone in their late 30s or early 40s might spend less than 5 percent of their income on car insurance premiums.

As you can see in the chart below, your insurance costs are only half of this equation. People in Pennsylvania, for instance, have the same percentage of income spent on insurance even though their insurance costs are several hundred dollars a year lower than New Jersey, which means that though they pay less for their car insurance, they tend to earn less overall as well.

While liability coverage is required by law in New Jersey, there’s a lot more to insuring your vehicle than just liability. Insurance is about protecting your financial interests in the event of an accident, so you may want to consider any or all of these types of coverage:

  • Liability – Liability insurance protects your financial welfare by paying for damages to another person’s vehicle if you are at fault in an accident. It also covers medical bills in the event of bodily injury someone else sustained in an accident where you were at fault.
  • Uninsured motorist coverage – Uninsured motorist coverage, often referred to as UM, is mandatory in New Jersey, depending on the type of liability coverage you choose. It covers you at the same levels as your liability coverage if you’re in an accident where an uninsured driver was at fault.
  • Collision – Collision insurance protects you by paying for damages to your vehicle if you’re at fault in an accident, whether you hit another vehicle or a stationary object such as a fence post. Since you’re responsible for your own damages if you’re in an accident in New Jersey, you may seriously want to consider having collision coverage.
  • Comprehensive – Comprehensive insurance covers damage to your car that isn’t caused during an accident. Some examples of what might be covered under a comprehensive policy are hail damage, theft, and vandalism.

Every insurance company has its own rules and guidelines as to what it will and will not cover under your comprehensive policy, so make sure you do your research before choosing a plan.

What additional liability is available in New Jersey?

When it comes to additional coverage, you’re required to carry Personal Injury Protection (PIP) according to state law. This coverage is often referred to as no-fault coverage.

Where uninsured motorist/underinsured motorist coverage takes the place of the liability insurance the other person should have (or doesn’t have enough of, depending on the situation), PIP applies no matter who was at fault in the accident. Both PIP and UM are required by law in New Jersey on anything more than the basic plan.

PIP is usually a smaller amount of coverage, typically $15,000 in New Jersey but as low as $2,000 in some other states, designed to cover your most basic needs if you require medical care due to an accident.

But PIP is about your medical needs. What about the needs of the other person if you’re at fault in an accident?

If you choose a standard policy, the state minimum is $15,000/$30,000 for bodily injury and $5,000 for property damage. That doesn’t mean it should be the maximum amount of liability coverage. You can always increase your levels of liability coverage, and most people should seriously consider carrying more than the state minimum.

You can always choose to buy more than the legal minimum of insurance. Many companies offer higher coverage levels, typically $50,000 to $100,000 in property damage and $250,000 per person/$500,000 per accident bodily injury, for which you will pay a higher monthly premium.

Hopefully, if you’re in an accident, everyone involved will have enough collision and PIP coverage to pay their bills, but what if you aren’t so lucky?

You could hit someone who has elected to carry the minimum coverage under the standard policy and has opted to have the right to sue another driver in an accident, so even in a no-fault state, it’s possible you could be held responsible for tens of thousands of dollars or more.

In the table below, pure premium is the portion of an insurance premium that reflects the basic costs of loss, not including overhead or profit.

When you’re choosing coverage, you may wish to consider the loss ratio of the company as well, so you may wish to reference the chart above to find that information. The loss ratio is the amount paid out in claims by a company versus the amount of premium taken in by the company.

According to the NAIC, a loss ratio in the 50s or 60s is a good one. It means they aren’t charging too much premium and they are regularly paying out claims to their customers.

What add-ons, endorsements, and riders are available in New Jersey?

Just because you have all of the core types of coverage mentioned above and higher-than-average levels of liability coverage doesn’t mean you’re fully protected. There are several other coverage types available that you may need to protect yourself financially, depending on your situation.

  • Umbrella policy – If you’ve done the math and you don’t think that $250,000/$500,000 in bodily injury and $100,0000 in property damage would be enough to protect your assets in an accident, you might consider an umbrella policy. Umbrella policies typically provide a minimum of $1 million in liability coverage.
  • Rental reimbursement – Rental reimbursement covers the cost of your rental car while the vehicle you own is being repaired because of an insured loss. For example, if someone damaged your car, comprehensive insurance would cover that cost, but rental reimbursement coverage would cover the cost of a rental car during repairs.
  • Roadside assistance – When it comes to tow trucks or basic repairs on the side of the road, roadside assistance coverage would help cover the cost of those services.
  • GAP insurance – GAP insurance typically covers the difference between what your insurance policy pays and the amount you still owe on your car. GAP insurance helps to prevent you from being forced to make payments on a totaled vehicle, but the type of GAP coverage available varies widely from company to company and state to state, so research carefully before buying.
  • Non-owner insurance – If you don’t own a car but still drive semi-regularly, you might need a non-owner insurance plan to provide you with third-party liability coverage to protect you financially.
  • Classic car insurance – The financial value of a classic or vintage car is often worth more than standard depreciation. If you have a classic car, you’ll need classic car insurance to make sure your vehicle is protected at its full value.
  • Usage-based/Pay-as-you-drive insurance – A device can be installed in your car or (an app installed on your phone) to record your driving information (speed, mileage) and report it to your insurance company, who then offers you discounts on your coverage for being a better driver. This can have unforeseen consequences, however, so consider carefully before buying.

Does gender and age affect my car insurance in New Jersey?

How New Jersey Laws for Insurance are Determined

Insurance laws are created the same way all other laws in New Jersey are created: through the legislative system.

Any legislator in New Jersey may propose or sponsor a new law, creating a new bill and potentially finding co-sponsors for the bill. It is then introduced during a legislative session, and if it’s approved it goes back to the beginning for a second reading.

It then gets scheduled by the Senate President or the General Assembly Speaker for yet a third reading, at which point it will be debated and passed if it gets enough votes. Then it is sent to the other house and undergoes the same process there.

At that point, it gets sent to the governor, who has the option to pass the law, veto the law, or request changes before passing the law.

Automobile Insurance Fraud in New Jersey

Insurance fraud isn’t just filing an illegitimate claim.

Filing false paperwork, agents stealing your premium payments, or purposely overestimating the damage in a claim are all forms of insurance fraud. In New Jersey, insurance fraud is considered a crime in the third degree unless you commit five or more acts of insurance fraud totaling $1,000 or more. At that point, it becomes a crime in the second degree.

Statute of Limitations

The law in New Jersey states that you have two years to file a lawsuit over personal injuries or for a wrongful death lawsuit and six years for property damage. Otherwise, you are beyond the statute of limitations.

The statute of limitations typically begins from the cause of action (i.e., your accident), so if you believe you’ve been in an accident or filed a claim that needs to go through the court system, make sure you file right away to avoid running into the statute of limitations and having your claim denied.

State-Specific Laws

While there are some laws that are basically the same from state to state, each state also has laws that are unique within their borders as well.

Penalties for Driving Without Insurance

There are consequences for driving without insurance in New Jersey, such as:

  • Fines – Fines for driving uninsured range anywhere from $300 to $5,000, depending on how and why you were fined and whether it’s your first offense.
  • Loss of license – Your license and registration may be suspended or even revoked for up to two years depending on the circumstance.
  • Reinstatement requirements – You may be required to pay a fee of $250 a year for up to three years.

Teen Driver Laws

Like most states, New Jersey has graduated driving laws for teens. This means that teens in New Jersey start out with a learner’s permit and slowly work up to a full driver’s license over time.

In New Jersey, a permit becomes an intermediate license after six months for drivers under the age of 21 and after three months for drivers 21 and older. The graduated licensing law applies to adults, but the night driving and passenger restrictions are waived for new drivers over the age of 21.

Older Driver’s License Renewal Procedures

In New Jersey, drivers of all ages are required to renew their driver’s license in person at the Motor Vehicle Commission (MVC). A vision screening is required for everyone in 10-year intervals, though senior drivers may be required to pass a vision screening at every renewal.

New Jersey has a medical review unit that evaluates drivers when the situation dictates to make sure they are safe to operate a vehicle. If you experience a medical issue that your doctor feels will render you unsafe behind the wheel, they may report you to the state for reevaluation. New Residents

New residents in New Jersey are required to get their license and registration transferred within 60 days of moving to the state.

You’ll need to bring proof of residency to transfer your license, pass a vision test, and pay any applicable fees. You can keep a motorcycle endorsement when transferring your license as long as you let the MVC representative know at the time you’re filing for your new license and pay the required fee.

License Renewal Procedures

In New Jersey, your application for renewal of an automobile or motorcycle driver’s license can be done directly at the Motor Vehicle Commission. If you’ve moved within the state, you have one week to notify the state of your change of residence.

Active military personnel and their immediate family members can renew their license up to six months before deployment. Those licenses will remain valid for up to 90 days after they return from duty.

Negligent Operator Treatment System (NOTS)

The Negligent Operator Treatment System is typically referred to as getting points on your license, which is a system used all over the country to motivate people to drive safely and remove the worst drivers from the roads.

In New Jersey, drivers get points on their license any time they are convicted of a moving violation. Drivers who get six or more points in a three-year period must pay a surcharge, which is an annual fee paid every year for three years — in addition to any court fees and other penalties that are assessed by the courts.

If you earn 12 or more points in a three-year period, your license will be suspended. There are some violations that will result in an automatic suspension of your license, including driving while intoxicated and driving without a license.

Rules of the Road

When it comes to the laws and regulations regarding driving and insurance, almost all of them are determined at the state level. Everything from minimum insurance requirements to highway speed limits is specific to New Jersey.

This means that knowing the law in one state doesn’t guarantee you’ll be following the law in another. To keep yourself safe and prevent traffic tickets, make sure you know and adhere to the traffic laws in New Jersey.

Fault vs. No-Fault

New Jersey is a no-fault state, which means drivers are required to pay for their own bills in the event of an accident. This isn’t as cut and dried as it seems, however, because drivers in New Jersey can choose between a basic or standard insurance policy.

With a basic policy, you have a small amount of property damage liability coverage and personal injury protection benefits and have elected a “limited right to sue” in the event of an accident.

What does it mean when you have a limited right to sue? It means that if you’re injured in an accident where someone else is at fault, you’re only able to sue for damages in a few specific instances such as losing a body part, losing a fetus, or significant disfigurement.

With a standard policy, you have more robust coverage than the basic plan, including bodily injury liability, and you’re given the option to choose an unlimited right to sue, meaning that you have all legal options at your disposal in the event of an accident where you were not at fault, including the ability to sue someone in a court of law.

Since drivers in New Jersey (and drivers passing through from other states) can potentially take you to court if you are at fault in an accident, choosing a basic policy could leave you financially unprotected.

Seat Belt and Car Seat Laws

New Jersey is a primary enforcement state, which means that police officers can pull you over and issue a ticket if they see you driving without a seat belt. If they pull you over for another violation, you can be given a second ticket for not wearing a seat belt in addition to your primary citation.

All passengers over the age of eight are required to wear a seat belt. Children seven and under are required to be in a car seat if they are under the height and weight recommendations of the car seat manufacturer.

Keep Right and Move Over Laws

The law in New Jersey requires drivers to keep right, with left lane usage limited to passing or turning left.

While some states prohibit passing on the right, New Jersey allows drivers to pass on the right in several circumstances. Drivers who are approaching emergency response vehicles are required to move over and reduce their speed, leaving a full lane of space if at all possible.

Speed Limits

New Jersey has two types of speeding laws – basic speeding laws and prima facie speed limits.

The basic speeding laws state that what is an appropriate speed is dictated by the circumstances. What is an appropriate speed for a sunny day isn’t the same as what would be reasonable on a rainy night, so drivers are required to drive at an appropriate reduced speed when the situation requires it.

Prima facie speed limits, also called presumed limits, state that the posted speed limit is technically the maximum but that you can avoid a ticket if you can show that you were not unsafe at the speed you were traveling.

A speeding violation can earn you fines of between $50 and $200 and up to 15 days in jail, although serving a jail sentence for speeding is rare. Fines are doubled for violations of driving 20 miles per hour over the limit or more. Also, keep in mind that there are certain portions of Route 130 where the fines are tripled.

Ridesharing

New Jersey has multiple rideshare options available, including carpool services along with options such as Uber and Lyft. Several companies offer insurance policies specifically for rideshare drivers, so if you drive for a rideshare company you may want to consider looking into them.

In 2019, New Jersey passed Sami’s Law, a set of requirements for identification of rideshare drivers. Under this law, rideshare drivers are required to prominently display identifying markers on the front and back windows of their vehicle to prevent people from mistaking random people for their hired ride.

Automation on the Road

In early 2019, the New Jersey legislature proposed Assembly Joint Resolution 164, which creates the New Jersey Advanced Autonomous Vehicle Task Force. The task force will conduct a study of autonomous vehicles and recommend various laws, rules, and regulations the state may enact to allow the vehicles to use the roads safely with other drivers.

Safety Laws

Much like every other state, New Jersey has put rules and laws in place to keep people safe while on the road. Whether it’s a law about texting while driving or about passing on the left, while crafting new laws, the state is doing its best to keep the citizens of New Jersey safe.

While knowing the laws is important, you should also remember that laws can change over time, so just because something was legal five years ago doesn’t mean it’s legal now.

Conversely, things that were illegal just a few years ago might be legal today, so make sure to do your research when it comes to driving safety laws.

DUI Laws

A person can be convicted of a DUI for operating a vehicle under the influence. The state takes the issue so seriously, in fact, that a vehicle owner can earn a DUI conviction for allowing an intoxicated person to operate the owner’s vehicle.

To be convicted, there must be evidence of your intent to drive, meaning you have actual physical control over a vehicle and are attempting to drive it, but there doesn’t need to be any actual movement of the vehicle.

In New Jersey, DUI is defined as showing a substantial decrease in mental or physical capabilities, but a driver can be convicted of DUI without showing signs of intoxication if their BAC is .08 percent or higher.

This is considered a per se DUI.

If you’re convicted of a DUI, you’re required to participate in a drug and alcohol screening and evaluation and complete treatment recommendations through an Intoxicated Driving Resource Center. Each day of treatment and screening requires you to complete at least six hours of treatment and pay $75, or $100 for second or third offenses, but days in the program can count toward any required jail term, for a total of up to 90 days.

If you’re convicted of a DUI, you can also be charged with a disorderly persons offense if you were driving a passenger under the age of 18 at the time of the DUI. A disorderly persons conviction carries additional community service hours and an extended license revocation.

If you’re arrested for DUI, the police will impound your vehicle for 12 hours and possibly request a breathalyzer test. Failing a breathalyzer can be used in court to prove a DUI charge, but refusing to take a breath test is against the law and will lead to license revocation.

Marijuana-Impaired Driving Laws

Medical marijuana use was approved in New Jersey in 2010, but recreational use is still prohibited by law. Regardless of whether you’re using marijuana legally, it’s still illegal to drive while under the influence of marijuana.

There are no laws in place specifically regarding marijuana use while driving, but you can be charged and convicted with a DUI in New Jersey if you show a substantial decrease in mental or physical capabilities.

Distracted Driving Laws

Texting, adjusting your GPS, eating, and talking on the phone are just a few of the distractions that drivers routinely face behind the wheel. Because these distractions are so dangerous, New Jersey and the neighboring states have laws put in place to protect people on the road, as evidenced by the chart below:

Road Fatalities in New Jersey?

According to the NHTSA, there were 564 traffic fatalities in New Jersey in 2018. Of those, 125 were alcohol-related fatalities and 114 were speeding-related fatalities.

Traffic accidents aren’t just caused by speeding and alcohol, however. Whether you’re playing on their phone or are surprised by a deer crossing the highway, a traffic accident can cause serious damage to your vehicle and leave you injured, or worse, dead.

Most Fatal Highway in New Jersey

Earlier we told you that speeding on certain sections of US-130 can cause you to be fined three times more than a normal speeding ticket. This isn’t surprising when you realize that US-130 is the most fatal highway in New Jersey.

US-130 has only had 11 fatal car crashes in the last 10 years, but it is known to have high numbers of fatalities for pedestrians. In fact, it has the most pedestrian fatalities in the tri-state area.

Fatal Crashes by Weather Condition and Light Condition

Weather and light conditions can affect the number of accidents on the road, with slick asphalt or poorly-lit streets increasing the odds of an accident.

Weather can also increase the severity of an accident, turning what otherwise could have been a minor fender bender into a situation where injuries or even fatalities occur.
